Me and my bf have an 8 month old and are trying to get an apartment can we legally get a 1 bedroom?

We live in Oklahoma and I was told that we had to get a 2 bedroom, but am trying to look further into it. Our son is still crib bound and i would consider him an infant, but i don't know the actual law.
